The purpose of Japan’s foreign technical intern trainee system is for foreign workers to learn skills in Japan and contribute to the development of their own country after returning to their home countries. However, the application of the Labor Standards Act to this system is limited.

The Labor Standards Act is a law to protect the rights and working conditions of workers. However, foreign technical interns have a different legal status than regular workers. They are in Japan for short-term training and have training contracts rather than labor contracts.

Certain protective provisions of the Labor Standards Act may not apply under this training contract. Specifically, some provisions regarding minimum wages, working hours, holidays, and working conditions may not apply. This is because technical interns are focused on training, so strict working conditions may not apply.

However, recently, problems with the working conditions and human rights protection of foreign technical intern trainees have been pointed out, and the government and related organizations are considering improvement measures. Systemic reforms are required, including reviewing the scope of application of the Labor Standards Act and strengthening the supervisory system.

The above is a general explanation of the reasons why the application of the Labor Standards Act to Japan’s foreign technical intern trainee system is restricted and the actual situation. For detailed information and the latest developments, we recommend that you refer to relevant legal and official government sources.

The Japanese government and related organizations are taking the following initiatives to resolve issues with the foreign technical intern trainee system.

System review and reform: The government is trying to solve the problem by reviewing and reforming the foreign technical intern trainee system. This includes improving working conditions, strengthening human rights protections, strengthening oversight systems and increasing system transparency.

Strengthening the supervisory system: The government is working to strengthen the supervisory system to oversee the working conditions and human rights protection of foreign technical intern trainees. This includes increasing the staffing of labor standards inspection offices and labor bureaus, and increasing the frequency and rigor of audits and inspections.

Enhancing education and training programs: The government and related organizations are working to enhance education and training programs for foreign technical interns. This not only improves technical and professional skills, but also provides knowledge about working conditions and workers’ rights.

Establishment of a hotline: The government has established a hotline for foreign technical intern trainees to provide consultation services. We have created an environment where technical intern trainees can anonymously seek advice or report if they have any issues regarding working conditions or human rights.

Collaboration and information sharing: The government and related organizations work together with related organizations such as the Labor Standards Inspection Office, Labor Bureau, foreign worker support organizations, and NGOs to share information and solve problems. This is expected to lead to improvements in working conditions and early detection of problems.

These efforts are being undertaken to improve working conditions and human rights protection for foreign technical intern trainees. However, system reform and problem solving may take time. For the latest information and specific initiatives, we recommend checking the websites and official announcements of relevant government agencies and organizations.

The Japanese government has set up a hotline for foreign technical intern trainees, providing an environment where interns with issues related to working conditions or human rights can consult and report. The details of the hotline and how to use it are explained below.

      Hotline name: Foreign Trainee Hotline

Provided by: Ministry of Health, Labor and Welfare

Target audience: Foreign technical intern trainees

      How to Use:

Phone: Dial the hotline phone number. Specific numbers can be found on the Ministry of Health, Labor and Welfare website and related guidance materials.

Consultation details: Tell the operator who answers the phone what you would like to discuss or report. Consultations can also be conducted anonymously.

Language Support: To accommodate the diverse needs of foreign technical intern trainees, our hotline is staffed with staff who speak multiple languages. You may also be able to select a language during the call.

Protection of personal information: The hotline takes measures to protect the personal information of callers. Measures are taken to respect the anonymity and privacy of those seeking advice and to prevent information leaks.

Response and guidance: Depending on the nature of the consultation, hotline operators will provide appropriate responses and necessary information. We may provide specific support, such as problem solving, advice, and directions to relevant institutions and organizations.
